Report on major regulatory developments during the quarter and expected developments for the next quarter

Quarterly regulation outlook reports compiles regulatory developments issued by global regulators (BCBS, FSB), supranational ones (with a focus on Europe), and some local geographies’ (USA, UK, Spain) for the quarter, and anticipate major changes in regulations for the following quarter, the following year, or on the longer term.

They are structured as follows: executive summary, which contains references to the most important regulatory changes for the period; forthcoming publications, providing details of documents that will be published during the next quarter, next year and in the longer term; and the body of the report, made up of a collection of summaries of relevant publications for the quarter.

In the third quarter of 2021, at the European level, the publication of the European Commission (EC) Delegated Act supplementing the Taxonomy is noteworthy, as well as the European Parliament (EP) and Council Regulation establishing the framework for achieving climate neutrality. At the local level, the draft Circular to financial credit institutions on liquidity, prudential rules and reporting obligations of the Bank of Spain (BoS) stands out.

In the second quarter of 2021, climate risk is one of the main protagonists in the publications of the main organisations at all levels (global, European and local). Also noteworthy is the publication of the TRIM results by the European Central Bank (ECB) and that the European Insurance and Occupational Pensions Authority (EIOPA) has launched the 2021 stress test.

During the first quarter of 2021, the publication of the European Central Bank (ECB) on the Outcome of its 2020 Supervisory Review and Evaluation Process (SREP) stands out. For its part, the European Banking Authority (EBA) has launched the 2021 EU-wide stress test and it has published a Consultation Paper (CP) on draft implementing technical standards (ITS) on Pillar 3 disclosures on environmental, social and governance risks (ESG).

During the fourth quarter of 2020, the publication of the FSB of the Global Transition Roadmap (GTR) for LIBOR stands out. At European level, several bodies have published standards and guidelines on ESG risks management and supervision.  At local level, the PRA has issued several Statements related to prudential treatment of software assets and Pillar 2.

During the third quarter of 2020, the publication by the IASB of amendments to IFRS 17 stands out at a global level. In the EU, it should be highlighted the publications by the European Commission of the Digital Finance Package and the ECB Guide on Assessment Methodology for the internal model method (EGAM). At a local level, the Bank of Spain published the Draft Circular to payment institutions and electronic money institutions, on public and private financial reporting standards and model financial statements. In addition, in the USA the Fed, FDIC, OCC, SEC and CFTC published the Final Rule on revisions to prohibitions and restrictions on proprietary trading and certain interests in, and relationships with, hedge funds and private equity funds.

The second quarter of 2020 is characterized by publications aimed to manage the impact of the COVID-19 outbreak. In addition, the EU Council published the taxonomy of sustainable activities, and the ECB launched a public consultation on the draft guide on climate-related and environmental risks. At the local level, the BoS published Circulars 2/2020 and 3/2020 amending Circular 4/2017 to credit institutions on public and confidential financial reporting standards and financial statement formats. In the UK, the PRA published the Policy Statement 11/20 on credit risk: PD and LGD estimation which updates again the SS 11/13 on IRB. In the US, the Fed, FDIC and OCC published the Regulatory Capital Rule on Temporary Exclusion of US Treasury Securities and Deposits at Federal Reserve Banks from the Supplementary Leverage Ratio (SLR) for Depository Institutions.

The first quarter of 2020 is characterized by publications aimed to manage the impact of the COVID-19 outbreak. At international level, the BCBS announced the deferral of the implementation of the final Basel III reform to provide additional operational capacity for banks and supervisors. In addition, the EC published the European Data Strategy and a White Paper on Artificial Intelligence, as well as a Proposal for a European Green Bond Standard. At the local level, the Spanish Government published Royal Decree 309/2020, which develops the legal regime for EFCs. In US, published a Provisional Final Rule to revise the TLAC Rule. In UK, the PRA published the Consultation Paper (CP) 2/20 on Pillar 2A: Reconciling capital requirements and macroprudential buffers.
